2.1 You agree to use the Site lawfully, in good faith, and in a manner consistent with its purpose: charitable, educational, ecclesiastical, heritage, and community outreach.

4. Donations, Payments & Memberships

4.1 If you donate, register, or become a member via this Site, you agree to provide accurate, current, and complete information.

4.2 All payment transactions are processed via secure third-party payment providers. We do not store or handle your full payment card details ourselves (unless otherwise disclosed).

4.3 Donations or membership fees are non-refundable except as required by law or as expressly stated (for example in a donation refund policy). Nothing in these Terms may override your rights under applicable laws (such as the Australian Consumer Law or GDPR) to refunds or rescission when those rights apply.

4.4 If you subscribe to recurring donations or subscriptions, you are responsible for cancelling them via the methods we provide or by contacting us. We may suspend or terminate recurring payments with notice.

8.2 Sections 3 (Intellectual Property), 4 (Donations/Payments, as to surviving obligations), 5 (Disclaimers), 6 (Limitation of Liability & Indemnity), 9, 10, 11, 12 and any other provision which by its nature should survive termination, shall survive termination or expiration of these Terms.

9. Governing Law, Jurisdiction & Dispute Resolution

9.1 These Terms are governed by and construed in accordance with the laws of the State of Queensland, Australia, and any dispute arising hereunder will be subject to the exclusive jurisdiction of the courts of Queensland, Australia (unless otherwise required by mandatory local law, e.g. for EU users).

9.2 For users in the European Union or European Economic Area, nothing in these Terms limits any rights you may have under the General Data Protection Regulation (GDPR) or other mandatory consumer protection laws in your jurisdiction.

9.3 Should a dispute arise, we encourage you to first contact us to try informal resolution. If no agreement is reached, you may seek mediation or pursue the dispute in court or tribunal as allowed by law.

10. Severability, Waiver & Entire Agreement

10.1 If any provision of these Terms is held to be invalid, illegal or unenforceable (under applicable law), that provision will be read down or removed to the minimum extent necessary, and the remaining provisions will continue in full force and effect.

10.2 Our delay or failure to enforce a right or provision under these Terms does not constitute a waiver of such right or provision.

10.3 These Terms, together with the Privacy Policy (and any other incorporated policies), represent the entire agreement between you and us concerning use of the Site, and supersede all prior agreements.
